JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Eight bottles of Indian Made Foreign Liquor were recovered from conscious possession of the petitioner. Submission on behalf of the petitioner is that the alleged recovery of Indian made foreign liquor does not constitute an offence under the Bihar Excise (Amendment) Act, 2016 against the petitioner. Moreover, petitioner is in jail custody since 16.05.2016 without having any criminal antecedent. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Patna city, Patna, in connection with Bahadurpur P.S.Case No. 93 of 2016.
