====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 03-09-2025 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks regular bail in connection with Udwant Nagar P.S. Case No.194 of 2024, registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act.

3. As per the prosecution case, there is recovery of 152 liter country made Mahua liquor from the abandoned place in bushes near the bank of Banas river.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case only due to local village politics. He further submits that petitioner has no concern with the alleged recovered liquor. Learned counsel submits that petitioner has been made accused on the basis of secret information and except the same, no material

He further submits that there is noncompliance of mandatory provision of law in preparing the seizure list. Learned counsel submits that petitioner has been remanded in this case and is in custody since 01.07.2025 and charge sheet has already been submitted in this case. He further submits that petitioner has one criminal antecedent and there is no chance of absconding the petitioner or tampering with the evidence and he undertakes to cooperate in the investigation and trial.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioners.

6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise Court No.II, Bhojpur, Ara in connection with Udwant Nagar P.S. Case No.194 of 2024.
