Petitioner seeks bail in a case registered under Section 47 of the Bihar Excise (Amendment) Act.
10 litres country made Mahua as well as apparatus of manufacturing country made liquor and 250 litres raw materials are said to have been recovered from the house of the petitioner but learned counsel for the petitioner drew my attention towards search cum seizure list which has been annexed at page-16 of the petition and submits that according to the aforesaid seizure list, the said recovery was made from Chhawani of S.C./S.T. Colony, Manuapul, P.S. Bettiah and moreover, the copy of the aforesaid
Patna High Court Cr.Misc. No.29918 of 2016 (2) dt.28-07-2016 2/2 seizure list was neither given to the petitioner nor his family members rather the copy of the said seizure list was received by Akhilesh Ram from whose house 13 litres country made Mahua liquor is said to have been recovered.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Bettiah, West Champaran in connection with Bettiah Muffasil (Manuapul) P.S.
