JUSTICE SANJAY PRIYA ORAL ORDER 10-10-2018 This application has been filed for modification of the order dated 19.07.2018 passed in Cr. Misc. No. 31029/2018, by which petitioner has been granted anticipatory bail in connection with Danapur P.S. Case No. 21/2018 to the satisfaction of learned A.C.J.M., Danapur.

Learned counsel for the petitioner has submitted that these petitioners are petitioner nos. 3 and 4 in the bail petition and are living in Vishakhapatnam as petitioner no. 3 is working in Steel Plant, Vishakhapatnam. Petitioner no. 4 is wife of petitioner no. 3. It is not possible to appear on each and every date fixed by the court as directed by the Hon'ble Court.

In view of such, order dated 19.07.2018 passed in Cr. Misc. No. 31029/2018 is modified to the extent that petitioners shall file necessary petition before the court below under Section 317 Cr.P.C. The court below shall pass appropriate order on such

Patna High Court Cr.Misc. No.63149 of 2018 (2) dt.10-10-2018 2/2 petition in accordance with law.

The petitioner will however remain present physically on the dates as and when required by court below. This Modification Petition is accordingly allowed. (Sanjay Priya, J.) Rakhi U T
