Petitioner apprehends arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act 2016 and 120(B) of IPC. Prosecution case is that 2964.96 litres of foreign liquor has been recovered from a truck.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner is neither the owner nor the driver of the vehicle in question. Petitioner has got no criminal antecedent.

Judge, Excise Court 02, Begusarai in connection with Bakhari P.S. Case No. 332/21 dated 17/11/2021 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
