JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 394 of the Indian Penal Code and Sections 25(1-b)a, 26, 27, 35 of the Arms Act. It would appear from perusal of the first information report that F.I.R. named accused, Raj Kumar Patel was caught after the alleged occurrence and snatched mobile was recovered from his possession. Furthermore, the first information report reveals that aforesaid co- accused, Raj Kumar Patel disclosed the name of petitioner.
Submission on behalf of the petitioner is that coaccused, Raj Kumar Patel has already been granted privilege of bail by a co-ordinate Bench of this court vide order dated
Patna High Court Cr.Misc. No.30053 of 2016 (4) dt.04-10-2016 2/2 04.03.2015 passed in Cr. Misc. No. 49266 of 2014 and so far as petitioner is concerned, except his criminal antecedent as well as above stated confessional statement of co-accused, there is nothing against him. Petitioner is in jail custody since 04.04.2015 and the investigation against him has already been completed. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Gopalganj in connection with Uchkagaon P.S. Case No. 281 of 2013.
