The petitioner apprehends his arrest in Madhepura Complaint Case No.647 of 2018 for the offences allegedly committed by the petitioner under Section 498A of the Indian Penal Code and under Section 4 of the Dowry Prohibition Act. Learned counsel for the petitioner submits that the petitioner is the husband of the complainant. Prior to institution of the present case, the petitioner filed Matrimonial Case No.49 of 2016 for restitution of conjugal rights. The petitioner is ready to keep his wife but the wife herself does not want to live with the petitioner.

No.49727 of 2019(2) dt.08-08-2019 2/2 Having considered the facts that much prior to filing of this complaint case, the petitioner filed Matrimonial Case No.49 of 2016 for restitution of conjugal rights and offer was made for reconciliation between the husband and the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Madhepura in connection with Madhepura Complaint Case No.647 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
