Heard the learned counsel for the petitioner as well as learned APP for the State.
The petitioner apprehends his arrest in connection with Baisi P.S. Case No. 89 of 2022, registered for the offences punishable under Section 7 E.C. Act.
The learned counsel for the petitioner has submitted that 220 bags of urea was recovered from a vehicle, to which the petitioner is owner. He has submitted further that the petitioner is a person of clean antecedent and has falsely been implicated in this case merely because he is the owner of the vehicle. He
Patna High Court CR. MISC. No.51904 of 2022(2) dt.20-01-2023 2/2 was neither arrested at the spot nor anything was recovered from his possession.
Considering the above-mentioned facts and circumstances as well as the clean antecedent of the petitioner, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Baisi P.S. Case No. 89 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided hereinabove, failing which the matter shall be brought to the notice of this Court.
