01-07-2015 Heard learned counsel for the petitioner and learned A.C. to Govt. Advocate - 12.

The present petition has been filed with a prayer to restore C.W.J.C. No. 12798 of 2008, which stood dismissed on 26-02-2015, due to non-prosecution. Earlier also, the writ petition was dismissed due to non-prosecution, however; it was restored. Learned counsel for petitioners submits that due to inadvertence, the case was not marked and as such, on the date, when the case was called out, none appeared.

After hearing the parties and considering the ground set-forth in the petition, same is allowed.

Let C.W.J.C. No. 12798 of 2008 be restored to its original file with an indication that in future, learned counsel for petitioners may remain vigilant in the present matter. (Rakesh Kumar, J.) Anay U
