The petitioner is apprehending his arrest in a case registered under Sections 147, 148, 149, 341, 342, 332, 333, 353, 337, 338, 427, 307, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case, in short, is that the accused persons surrounded the police station and started abusing the police party and others and also started throwing the burning tyres. They were in rage and were shouting slogans against the administration.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the

Patna High Court Cr.Misc. No.52591 of 2018(2) dt.10-09-2018 2/2 petitioner. Altogether 17 persons were named in the FIR along with 100 unknown. There is general and omnibus allegation has been levelled against the petitioner. No specific overt act has been alleged against the petitioner. The nature of injury is simple in nature.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R./complaint case. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st Araria in connection with Jogbani P.S. Case No. 126/17, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
