The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 379, 411 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that he had parked his motorcycle in the night in front of his house but in the morning he could not locate the same and thus based on CCTV footage lodged the FIR regarding theft of his motorcycle.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and his name transpired in the confessional statement of apprehended

Patna High Court CR. MISC. No.62188 of 2021(2) dt.13-07-2022 2/2 accused which has no evidentiary value, it is next submitted that petitioner is a young boy of 19 years of age and he was not identified in the CCTV footage.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner and the fact that petitioner is a young boy of 19 years and is a person with clean antecedent, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Raxaul P.S. Case No. 68 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. One of the bailors of the petitioner shall be his father Khaliku Zama.
