====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 07-08-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 12.05.2019 in a case for the offence registered under Sections 392 and 414 of the IPC.

The prosecution story, in brief, is that on 11.05.2019 at about 9.00 P.M., the informant had gone to market for taking some articles and during course of returning he was talking on his Mobile. In the meantime, Motorcycle borne two miscreants came and snatched his Mobile and fled away. During course of fleeing away, the Motorcycle ascended on a Brick lying on the road as a result of which, the Motorcycle staggered and both

Patna High Court CR. MISC. No.48403 of 2019(2) dt.07-08-2019 2/3 miscreants fell down. People apprehended both miscreants. Thereafter, police patrolling party reached there. On being asked, they disclosed their names as Amit Kumar and Sanu Kumar (petitioner). On being searched, looted Mobile of the informant was recovered from left pocket of the petitioner while two other Mobile phones were recovered from right pocket of his Pant.

It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tempering with the witnesses alleged against the petitioner. The petitioner has been made accused in the present case due to mistake of fact. It is alleged that the petitioner snatched the Mobile Phone of the informant. It is further submitted that the petitioner may be released on bail after completion of four months in custody.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail after completion of four months in custody on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount
