The petitioner seeks bail in a case registered for the offences under Section 399, 402 of the Indian Penal Code and Section 25(1-b)A/26/35 of Arms Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 03.07.2021, he is a person with clean antecedent, charge-sheet has been submitted and allegation is of recovery of a mobile with sim from the petitioner while arms were recovered from other co-accused. The learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case despite no arms was recovered.

The learned A.P.P. vehemently opposes the bail

Considering the fact petitioner is in custody since 03.07.2021, he is a person with clean antecedent, charge-sheet has been submitted and no arms has been recovered from his possession, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with K. Hat (Maranga) P.S. Case No. 594 of 2021.

The application stands allowed.
