Upon repeated call no one appeared on behalf of the petitioner and counsel for the State appeared. The petitioner seeks regular bail in connection with Begusarai Muffasil P.S. Case No.393 of 2022 lodged under Sections 272 and 273 of the Indian Penal Code and Sections 30(a) (d) of Bihar Prohibition and Excise Act, 2018. Learned counsel for the State submits that there are total recovery is 95 liter of illegal foreign liquor and other liquor in this case. Counsel further submits that antecedent of the petitioner is clean and she is in custody since 28.07.2022. Counsel further submits that petitioner has been apprehended
Patna High Court CR. MISC. No.52059 of 2022(2) dt.25-11-2022 2/2 from the place of occurrence. He further submits that from the F.I.R., it transpires that the present petitioner is lady, she is accused along with her husband also and other accused persons. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge-I, Begusarai in connection with Begusarai (Muffasil) P.S. Case No. 393 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C..
With this observation, the bail application stands allowed.
