JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-08-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 15.6.2016 in a case registered for the offences punishable under Section 290 of the Indian Penal Code and sections 20 and 22 of the NDPS Act. The prosecution case is that on 15.6.2016 at 7 A.M. the informant being S.I. of Kadamkuan police station, received information that one person is selling ganja near Apsara round about when the informant reached at the spot then the petitioner tried to escape but he was apprehended and from his possession 100 sachets of 5 grams each and 40 sachets of 10 grams each were recovered. The total recovered ganja weighed 900 grams. It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.32221 of 2016 (2) dt.01-08-2016 2/2 that the recovery is of small quantity. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Patna in connection with Special Case No. 31 of 2016 arising out of Kadamkuan P.S. Case No. 255 of 2016.
