1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The learned counsel for the petitioners, after some argument realizing his difficulty, seeks permission to withdraw the present anticipatory bail application with respect to petitioner no.1, namely, Sanju Singh @ Ajay Kumar.

3. Permission is accorded.

4. Accordingly, instant petition is dismissed as withdrawn with respect to petitioner no.1, namely, Sanju Singh @ Ajay Kumar.

5. The petitioner nos.2 and 3 seek bail in anticipation

Patna High Court CR. MISC. No.53336 of 2025(2) dt.18-08-2025 2/3 of their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 125, 303(a), 352, 351(2) and 3(5) of the B.N.S.

The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that his motorcycle was dashed by an auto accidentally, when the informant told the driver of the auto to drive carefully, on which the petitioners, who were in the auto started assaulting him and Shivam snatched his laptop which he was carrying for repair along with his family. Further, Shivam snatched his fan and ring worth Rs.1,60,000/-, thereafter the uncle of the informant stopped the auto near bus stand when Sanju assaulted the informant by a rod causing injury on head. Further, Shivam assaulted his uncle by an iron rod causing injury on head.

7. The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is also submitted that the injury suffered by the uncle of the informant has been opined to be simple and the injury of the informant inflicted by Sanju has been opined to be grievous. It is next submitted that on account of an accident, an altercation had taken place in which both sides assaulted each

8. Learned A.P.P. opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioners, the petitioner nos.2 and 3, abovenamed, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on anticipatory bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nawada in connection with Kadirganj P. S. Case No.267 of 2024, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
