JUSTICE RAKESH KUMAR ORAL ORDER 16-06-2015 Heard Sri Shiv Kumar Dwivedi, learned counsel for the petitioners and Sri Dinesh Singh, learned A.P.P. Three petitioners, apprehending their arrest in connection with Inarwa P.S. Case No. 77 of 2014, registered for the offence under Section 353, 143, 144, 145, 189, 341, 323, 224, 225, 504 and 506 of the Indian Penal Code, have prayed for grant of anticipatory bail.

Learned counsel for the petitioners submits that save and except offence under Section 353 of the Indian Penal Code, which has been incorporated in the present F.I.R. all other offences are bailable offence. He submits that prior to lodging of

Patna High Court Cr.Misc. No.19191 of 2015 (2) dt.16-06-2015 2/2 the present case, from the petitioners' side a complaint was filed against the informant of the present case, who is a Police Officer vide Annexure - 2 to the present petition and in retaliation the present F.I.R. has been lodged.

In view of the facts and circumstances as well as nature of accusation, in the event of arrest or surrender within a period of one month from today, let the aforesaid three petitioners namely Ramchandra Yadav @ Feku Yadav, Ram Bahadur Yadav and Veer Bahadur Yadav be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Inarwa P.S. Case No. 77 of 2014 under the conditions as contemplated under Section 438(2) of the Code of Criminal Procedure. (Rakesh Kumar, J) Praful/- U T
