The petitioner seeks bail in a case instituted under Sections 384 of the Indian Penal Code and later on Sections 13, 16 and 18 of U.A.P. Act has been added.
The prosecution story, in brief, is that on 06.05.2015 at about 10.00 A.M., the informant received a call from mobile bearing no. 9102039902, by which, ransom has been demanded and threatening to commit murder, if the demand was not fulfilled. The informant also received the same call on 15.05.2015.
It has been submitted on behalf of the petitioner that
Patna High Court Cr.Misc. No.36268 of 2016 (3) dt.25-10-2016 2/2 the petitioner is in custody since 22.03.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the First Information Report. His name has come on the basis of confessional statement of co-accused. The other co-accused has been granted bail vide Cr. Misc. No. 24924 of 2016.
On behalf of the state, it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Hilsa (Nalanda), in connection with Hilsa P.S.
