Petitioner prays for bail in connection with Bihta P.S.Case No. 445 of 2017 registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code. Allegation as per FIR is that some miscreants have taken away the truck of the informant and later on truck was recovered and petitioner was named by witness.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is in custody for more than one year.

Heard learned APP also, who has opposed the prayer for bail stating that this is a case of highway robbery. Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.52354 of 2018 (2) dt.05-10-2018 2/2 circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage.

However, since the petitioner is in custody for more than one year, learned trial court is directed to expedite the trial. With the above observation, this application is dismissed. (Vinod Kumar Sinha, J) spal/- U T
