JUSTICE RAKESH KUMAR ORAL ORDER 16-08-2016 Heard Sri Birendra Kumar Sinha, learned Senior Counsel, who was assisted by Smt. Madhuri Lata, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody in Siwaipatti P.S. Case No.52/2014 registered for the offence under Sections 376(G), 302, 201 and 120(B) of the Indian Penal Code, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that in the F.I.R, though the informant has suspected that her minor daughter was gang raped before murder, during postmortem examination, no such injury was found. Besides hearing learned counsel for the parties, I have also perused the materials on record. After perusing the material on record as well as criminal antecedent of the petitioner, mentioned in paragraph-3 of the petition, I am not inclined to extend the privilege of bail.

The petition stands dismissed.
