The petitioners seek bail in a case instituted for the offences under Sections 147, 148, 341, 323, 324, 447, 448, 379, 307, 504, 506/149 of the Indian Penal Code in which section 302 IPC was added later on.
The prosecution case in short is that the accused persons came to the house of the informant and started assaulting the informant and when his son came in rescue, he was assaulted due to which he sustained and later succumbed to the injury.
It has been submitted on behalf of the petitioners that
Patna High Court CR. MISC. No.49450 of 2019(2) dt.08-08-2019 2/2 the petitioners are in custody since 1.3.2019 and have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. Charge-sheet has been submitted in the present case. General and omnibus allegation has been made against the petitioners and other co-accused persons. No specific injury has been attributed against the petitioners. No vital injury is said to have been caused by the petitioner. The petitioners have falsely been implicated in the present case.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Kishanpur P.S. Case No. 27/19.
