JUSTICE RAKESH KUMAR ORAL ORDER 16-08-2016 Heard Sri Vijay Kumar, learned counsel for the petitioner and Sri Bharat Lal, learned A.P.P. The sole petitioner who is in custody only since 30.5.2016 in a case which was registered in the year 2014 vide Chapra Town P.S. Case No. 277 of 2014 registered for the offence under section 326, 307, 427, 120( B) , 34 of the Indian Penal Code and 3/4 of the Explosive Substances Act, has prayed for grant of bail mainly on the ground that other three similarly accused person were granted bail by this court vide order dated 3.3.2015 vide Cr. Misc. No. 49990 of 2014 .

Keeping in view the fact that petitioner along with other

Patna High Court Cr.Misc. No.31908 of 2016 (2) dt.16-08-2016 2/2 three accused, who were granted bail was made accused in the year 2014 and petitioner is in custody only since 30.5.2016 the court is of the opinion that petitioner may not be granted bail at this moment even on the ground of parity. The prayer for bail stands rejected.
