====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 28-01-2022 Heard learned counsel for the petitioner, complainant and learned APP for the State.

Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 393 of the Indian Penal Code.

The prosecution case as per F.I.R is that when the informant was returning to his village with cash of

No.8246 of 2021(4) dt.28-01-2022 2/3 Rs. 72,000/-, on way, all the F.I.R named accused persons including the petitioner intercepted him and on point of gun they started snatching cash from the informant. However, the cash could not be taken away as the villagers came on raising alarm by the informant. It is submitted by learned counsel for the petitioner that petitioner and informant are known to each other and in the background of some business transactions, the present accusation has been levelled against the petitioner. Moreover, as per the own version of the informant, the cash could not be snatched by the miscreants. A statement has been made in para 3 of the petition that petitioner is accused in one other case in which he is on bail.

Considering the aforestated facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands)

Patna High Court CR. MISC. No.8246 of 2021(4) dt.28-01-2022 3/3 with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Katihar in connection with Pranpur P.S. Case No. 06 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
