Petitioners apprehend arrest in connection with Lakhisarai (Kawaia) P.S. Case No. 331 of 2021 registered for the offence punishable under section 302 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

Learned counsel appearing for the petitioners submits that petitioners have not committed any offence as alleged in the first information and they have been falsely implicated in this case due to admitted land dispute between

Patna High Court CR. MISC. No.62362 of 2021(5) dt.29-03-2022 2/2 the parties. The present first information report has been lodged after 17 years of the occurrence. It is further submitted that for the same occurrence earlier also a F.I.R. was lodged vide Lakhisarai P.S. Case No. 109 of 2004 by the father of the present informant in which police after investigation submitted final form which was accepted by the court below with observation that there is no protest available on the record, as is evident from Annexure-2 (sereis).

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai (Kawaia) P.S. Case No. 331 of 2021 subject to the conditions laid down under section 438(2) Cr.P.C.
