Petitioner seeks bail in a case registered for the offences punishable under Sections 401 and 414 of the Indian Penal Code.

Submission is that petitioner is not named in the F.I.R., rather name of the petitioner surfaced in the confessional statement of co-accused. Nothing was recovered from the possession of the petitioner, nor petitioner was put on Test Identification Parade. Only due to his criminal antecedents, he has been implicated in this case.

Considering the facts, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.49976 of 2019(2) dt.09-08-2019 2/2 Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Bhagalpur G.R.P.S Case No.34 of 2019, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below having immovable property in their name and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
