JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 498A/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The basic accusation is of torture for non-fulfilment of the dowry demand.

It is submitted by learned counsel for the petitioner that the petitioner filed Matrimonial suit No. 43 of 2014 for restitution of conjugal life and also ready to keep her as wife with full dignity and honour, a statement to that effect has been made in para 9 of the petition.

Learned counsel for the informant submits that the informant is not ready to accept the offer of the petitioner due to past conduct of the petitioner. The informant claims some

It is submitted by learned counsel for the petitioner that in pursuance to the order passed in quashing application, the petitioner is making payment of Rs. 750/- per month to the informant.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Madhepura in connection with Madhepura Mahila P.S. Case No. 17 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. The bail bonds of the petitioner shall be accepted on verification of the fact that up-to-date payment of maintenance amount as directed by the court is being paid. This order will not preclude the informant to claim maintenance at appropriate forum.
