ANJANA MISHRA ORAL ORDER 30-08-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner apprehends his arrest in connection with Ram Krishna Nagar P.S. Case No. 227 of 2015 for the offences registered under Sections 341, 323, 337, 338, 504, 506/34 of the Indian Penal Code and under Section 3(X) of the Prevention of Atrocities Act.
Learned counsel for the petitioner submits that the allegation itself shows the petty nature of the occurrence, alleged to have been committed. Furthermore, the provisions of the SC/ST Act have been brought in only to make the offence graver and no case is made out against the petitioner because the same has admittedly not been made in a public place or in public view.
Having considered the submissions of the parties and

No.32375 of 2016 (2) dt.30-08-2016 also the fact that the petitioner has got no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Patna in connection with Ram Krishna Nagar P.S. Case No. 227 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) Jagdish/- U T
