JUSTICE SUDHIR SINGH ORAL ORDER 30-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 25(1-B)A and 26 of the Arms Act.

Allegation is that on secret information informant along with police force proceeded towards village Nonha and apprehended five accused persons including petitioner. On search from the possession of the petitioner one loaded country made pistol and ten cartridges were recovered.

It has been submitted on behalf of the petitioner that he is in custody since 8.9.2015. Chargesheet has been submitted against the petitioner. No allegation of tampering of witnesses is alleged against the petitioner. One loaded country made pistol along with ten live cartridges is said to have been recovered from his possession. There is no compliance of Section 100 of the Code of Criminal Procedure.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like

Patna High Court Cr.Misc. No.28757 of 2016 (4) dt.30-08-2016 2/2 amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Mansi P.S. Case no. 190 of 2015 (G.R. no. 2246 of 2015).
