JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

The son of the informant dashed a she-goat with tractor when the mob assaulted the son of the informant, thereafter, the informant reached the spot and tried to take his son to hospital but he was obstructed by the mob by pelting stones. Subsequently, the son of the informant succumbed to the injury. It is submitted by learned counsel for the petitioner that the accusation is omnibus and general. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Patna High Court Cr.Misc. No.20042 of 2015 (3) dt.29-07-2015 2/2 Learned APP, after going through the case diary, submitted that the petitioner was also a member of the mob. Considering the fact that during investigation the petitioner was found only a member of unlawful assembly, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Rosera, Samastipur in connection with Rosera P.S. Case No.164 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
