JUSTICE SUDHIR SINGH ORAL ORDER 03-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Section 307 and other allied Sections of the Indian Penal Code.
The allegation against the petitioner is of assaulting the son of the informant with sharp cutting weapon on his head as a result of which his son became badly injured and thereafter assaulted with lathi- danda and also taken away 50 Kg. fish. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. General and omnibus allegation has been made against the petitioner. From perusal of the case diary it appears that no injury report has been enclosed, hence the allegation made by the prosecution cannot be

On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Danapur (Patna) in connection with Shahpur P.S.Case No. 162/2013, subject to the conditions as laid down u/s 438(2) Cr.P.C.
