JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-09-2016 The above said petitions arose out of Civil Line P. S. Case No. 422 of 2014 registered for the offences punishable under
Patna High Court Cr.Misc. No.27424 of 2016 (3) dt.06-09-2016 2/2 Sections 461 and 379 of the Indian Penal Code and, accordingly, common order is being passed in the said petitions. Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are not named and it appears that in course of investigation, one co-accused Md. Rashid @ Pappu was caught and huge quantity of fire-arms were recovered from his house. The aforesaid co-accused Md. Rashid disclosed the name of petitioners and others and thereafter petitioners were arrested and they also made their confessional statements. The investigation against the petitioners has already been completed and it appears that except the aforesaid confessional statements there is nothing against the petitioners. Moreover, having, more or less, similar allegations some co-accused have already been granted privilege of bail.
Accordingly, petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Civil Line P.S. Case No. 422 of 2014.
