17-06-2015 Heard Dr. Shashi Shekhr Kishore, learned counsel for the petitioner and Sri Yogendra Kumar, learned Addl. Public Prosecutor.

The sole petitioner, apprehending his arrest in Triveniganj P.S. Case No. 15 of 2015 registered for the offence under Sections 302, 201/34 of the Indian Penal Code, has prayed for grant of anticipatory bail.

Learned counsel for the petitioner submits that ofcourse, in the F.I.R., petitioner's name has been arrayed in accused column, but the informant only on the basis of suspicion has implicated the petitioner as one of the accused. He submits that the petitioner was cousin brother of the

No.20054 of 2015 (2) dt.17-06-2015 2/3 deceased husband of the informant and it is true that there was some dispute in between the petitioner and husband of the deceased, but fact remains that in the present case, there was no involvement of the petitioner, only on the basis of old bitter relation, the petitioner has been made accused in the present case. He accepts that investigation in the case is still continuing.

In view of the fact that only on suspicion, the petitioner has been made accused, the Court is of the opinion that it is a fit case for extending the privilege of anticipatory bail during the investigation of the case.

Accordingly, let the petitioner namely Sintu Kumar @ Santu Kumar be enlarged on bail in the event of his arrest or surrender before the court below within a period of one month from today on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Supaul in connection with Triveniganj P.S. Case No. 15 of 2015, subject to condition as laid down under Section 438(2) of the Cr.P.C. It is made clear that if during investigation, accusation against the petitioner is found true and charge-
