The petitioner seeks bail in Mokama P.S. Case No. 103 of 2001 dated 08.06.2001 instituted under Section 147/148/149/302 of the Indian Penal Code and 27 of the Arms Act. This is the third attempt of the petitioner for bail as earlier such prayer was rejected by order dated 14.01.2015 passed in Cr. Misc. No. 48160 of 2014 by which the Court below was directed to expedite the trial and conclude the same within nine months. Learned counsel for the petitioner, at the very outset fairly submitted that examination of prosecution witnesses has been closed after examining only two witnesses out of seven witnesses. In view thereof, the Court finds that the onus is now on
Patna High Court Cr.Misc. No.33146 of 2016 dt.15-03-2017 2/2 the petitioner to get the trial concluded at the earliest. In such background, the Court is not inclined to consider the prayer for bail to the petitioner.
