JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 366A,372,341,504,506 and 120B of the Indian Penal Code.
It is alleged that the petitioner enticed away the minor sister of the informant, subsequently, the brothers of the petitioner admitted that the victim girl is with the petitioner and they promised the informant that she will return very soon. It is submitted by the learned counsel for the petitioner that in 164 Cr.P.C. statement though the victim got her age recorded as 18 years when the court assessed her age as 16 years where she admitted that she was in love with the petitioner and
Patna High Court Cr.Misc. No.11236 of 2015 (2) dt.24-04-2015 2/2 married with him and she is pregnant. The medical board assessed her age as 18-19 years. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, East Champaran, Motihari in connection with Turkulia P.S. Case No. 668 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
