Petitioner happens to be the husband of the deceased, who died of her burn injuries. Initially, the case was lodged under Section 302 of the IPC on the basis of written report of the informant who claimed that deceased was burnt to death by petitioner and his other family members. In course of investigation at paras-26, 27 and 28 of the case diary, three witnesses claimed to have seen the deceased burning in her house. The aforesaid witnesses also claimed that when they reached in the house of the petitioner they saw the deceased burning in flame and her in-laws were trying to extinguish the fire and after that the in-laws of the deceased made attempt to take her hospital but unfortunately deceased died on way. Police after investigation came to

Patna High Court Cr.Misc. No.30239 of 2016 (3) dt.20-10-2016 2/2 conclusion that the death of the deceased was suicidal death and that is the reason police submitted chargesheet under Section 306, 201 and 34 of the IPC.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Jehanabad in connection with Ghoshi P.S.Case No.295 of 2013.
