JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 307/34, 341, 323 and 504 of the Indian Penal Code.

Petitioner and other F.I.R. named accused are said to have assaulted one Krishna Yadav, while the aforesaid Krishna Yadav as well as the petitioner and his associates had been lodged in Central Jail, Buxar.

Submission on behalf of the petitioner is that Section 307 of the Indian Penal Code is not applicable in this case and so far as rest sections are concerned, the same are bailable in nature. Considering the aforesaid facts and circumstances as

No.28638 of 2016 (2) dt.25-07-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar Nagar P.S. Case No. 153 of 2016.
