JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 20, 22 of N.D.P.S. Act. 12.5 kg. ganja is said to have been recovered from joint possession of petitioner and other accused and accordingly, petitioner was remanded in the case on 30.09.2015. Earlier the prayer for bail of the petitioner was rejected but up till now, only charge could be famed against the petitioner.

Submission on behalf of the petitioner is that the seized recovery is much less than commercial quantity and moreover, petitioner does not have any criminal antecedent.

No.32194 of 2016 (2) dt.31-08-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that there is no possibility of conclusion of trial of the petitioner in near future, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cumSpecial Judge, Aurangabad in connection with Barun P.S. Case No. 141 of 2015.
