JUSTICE SUDHIR SINGH ORAL ORDER 06-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 386, 387, 379/34 of the I.P.C. Later on, Section 411 of the I.P.C. was also added.

The accusation is of robbing Tata Sumo vehicle of the informant by the accused persons including the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.4.2015 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The name of the petitioner has figured on the basis of the photographs of the suspect miscreants displayed in the local Police Station. There is no recovery of any incriminating article from the possession of the

Patna High Court Cr.Misc. No.29341 of 2016 (3) dt.06-09-2016 petitioner. The co-accused Pankaj Mandal has been granted bail vide Cr.Misc.No.677 of 2016. The co-accused Sachin Kumar @ Sanni has been granted anticipatory bail vide Cr.Misc.No.29045 of 2015 and the co-accused Ranveer Kumar @ Ranveer Mandal, Pappu Mandal have been granted anticipatory bail vide Cr.Misc.No.41890 of 2015.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Sultanganj P.S. case No.57 of 2015.
