Informant had alleged that a sum appertaining to Rs. 1,25,500/- was given to the petitioner to deposit in lieu of registering challan and the same has been misappropriated by him in connivance with Parsuram Chaubey. Furthermore, has also been alleged that on repeated demand they had assured him to return the amount but did not. On 28.05.2018 when he approached them, both abused him and further threatened him with dire consequences. The occurrence is of dated 03.05.2018 while the case has been instituted on 02.06.2018 and there happens to be no description with regard to the delay in activity at the end of informant apart from the fact that

No.52867 of 2018 (2) dt.06-09-2018 there would have been necessary step at the end of the informant on the day of misappropriation itself and that amount was of a customer which was paid for getting a document registered. Furthermore, petitioner happens to be in custody since 24.07.2018. Accordingly, petitioner Shiv Kumar Lal is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Mohania P.S Case No. 326 of 2018, G.R. No. 1391 of 2018.
