11-09-2018 Heard Sri Tribhuwan Narayan, learned counsel for the petitioners. None appeared on behalf of State. Seven petitioners, who are named as accused in the F.I.R. apprehending their arrest in Mohania P.S. Case No. 376 of 2018 registered for offence under Sections 147, 148, 149, 353, 332, 333, 337, 307, 379/511 of the Indian Penal Code and Section 27 of the Arms Act, 1959, have prayed for grant of anticipatory bail.

Learned counsel for the petitioners submits that there is no specific accusation against the petitioners. He submits that

Patna High Court Cr.Misc. No.53777 of 2018(3) dt.11-09-2018 2/2 in the case, an accident had taken place, in which, villagers were agitated and after arrival of the police, police party was attacked by a mob and this is the reason that F.I.R. was lodged against altogether 32 named accused and 150-200 unknown accused persons.

Be that as it may, I am of the opinion that such type of offence is regularly happening in our State and as such, entertaining the anticipatory bail petition in such case will amount to encourage such offence. I do not find any ground to pass any positive order.
