The petitioner, who is in custody, seeks bail in connection with Sessions Trial No. 54 of 2017 arising out of Belaganj P.S. Case No. 180 of 2016 registered for the offence punishable under Section302/34 of the Indian Penal Code. FIR was lodged against four unknown persons.

Name of the petitioner has surfaced in this case on the basis of confessional statement of Sashi Kumar @ Rohit Kumar. There is no eye-witness of the occurrence. He has been implicated in this case only on suspicion and mobile was recovered from the possession of petitioner which belongs to the informant but the petitioner has purchased that mobile from a mechanic.

Patna High Court Cr.Misc. No.54132 of 2018(2) dt.05-10-2018 2/2 Petitioner has no knowledge about the committing murder of Munni Kumari. It has been further submitted that petitioner has no criminal antecedent and he is in custody since 04.07.2016.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 1st Gaya, in connection with Sessions Trial No. 54 of 2017 arising out of Belaganj P.S. Case No. 180 of 2016.
