Petitioner seeks bail in a case registered under section 120B of the Indian Penal Code, section 3/ 4 of the Explosive Substance Act and various sections of the U.A.P. Act.

Petitioner is in jail custody since 15.9.2015 on the accusation that 5 kg aluminum nitrate power like substance, detonator and gelatin like substance, cane, 15 meter wire etc are said to have been recovered from the hut of the petitioner. Submission on behalf of the petitioner is that nothing was recovered from the hut of the petitioner and moreover, aforesaid hut was open and the aforesaid so-called aluminum nitrate and other articles have not been sent for chemical examination. No doubt, petitioner carries criminal antecedent but there is nothing on record to show that seized articles were sent for chemical

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Jamui in U.A.P. Case no. 100/2015 arising out of Laxmipur P.S. Case no. 180/2015.
