The petitioners are apprehending their arrest in a case registered under Sections 341, 323, 504, 506, 302/34 of the Indian Penal Code. The prosecution case, in short, is that on 26.04.2018 the grand father-in-law of the informant had gone to the field for irrigation, accused Jitendra Sah abused him and on hulla the informant reached there. Then the accused persons including the petitioners also reached there. Accused Jitendra Sah assaulted her grand father-inlaw by lathi and slaps, due to which he sustained injuries. He was taken to the Hospital and during treatment he died. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners
Patna High Court Cr.Misc. No.53369 of 2018(2) dt.17-09-2018 2/2 have falsely been implicated in the present case. The main allegation is against the co-accused Jitendra Sah, who is alleged to have assaulted the deceased. There is no overt act alleged against the petitioners. No injury has been caused upon the deceased by the petitioners. There is admitted enmity between the parties. Petitioner No.3 is a lady.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VIIth, Saran at Chapra in connection with Doriganj P.S. case No.112 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
