JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-02-2024 The present petition has been filed for restoration of a writ petition bearing CWJC No.23697 of 2019, which has stood dismissed for non-compliance of the peremptory order dated 29.11.2019.

The learned counsel for the petitioner has submitted that after this Court had directed for removal of the defects, within a period of four weeks, vide order dated 29.11.2019, the counsel for the petitioner had asked the office clerk to remove the defects and he was under the impression that he might have removed the defects, nonetheless, subsequently it came to the knowledge of the learned counsel for the petitioner that the aforesaid writ petition has stood dismissed on

Patna High Court MJC No.1926 of 2021(2) dt.08-02-2024 2/2 account of non-compliance of the peremptory order dated 29.11.2019. It is further submitted that a sympathetic view be taken and the aforesaid writ petition be restored to its original file.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner as also considering the averments made in the present petition, I deem it fit and proper to restore the aforesaid writ petition bearing CWJC No.23697 of 2019 to its original file subject to the petitioner removing the defects pointed out by the registry within a period of three weeks from today. 4.

The present restoration petition stands disposed off on the aforesaid terms.
