JUSTICE SUDHIR SINGH ORAL ORDER 28-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 366 of the Indian Penal Code.

Allegation against petitioner is that he is said to have enticed away daughter-in-law of the informant on the pretext to marry her.

It has been submitted on behalf of the petitioner that he is in custody since 20.1.2016. Chargesheet has been submitted against petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. He has falsely been implicated in the present case. In para-80 of the case diary C.D.R. report of the mobile of the victim has been stated. On the alleged date of occurrence the victim had talked to Abdul Kalam, Kamasujaha and Israfil. The C.D.R. report does not disclose anything in respect to the petitioner. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

Patna High Court Cr.Misc. No.34256 of 2016 (3) dt.28-09-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Sheohar, in connection with Piprahi P.S. Case no. 91 of 2015.
