JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-11-2022 The present writ petition has been filed seeking the following relief :- "That this writ application has been filed for issuance of direction to the Respondents for removal of encroachment from Mauza-Korra, Thana No. 47, Khesara No. 779 status-Aam Rasta (Public Road)/ Survey Gali, Anchal- Phulwari Sarif, Police Station- Janipur, District- Patna." After some arguments, the learned counsel for the petitioner submits that in view of the fact that Encroachment proceedings, initiated vide Encroachment Case No. 12 of 2017-

Patna High Court CWJC No.18541 of 2021(2) dt.03-11-2022 2/2 18 has already stood concluded and the Circle Officer, Phulwarsharif Circle, Patna has already written to the SubDivisional Officer, Patna Sadar, Patna vide memo dated 13.09.2019, to depute force for the purposes of removal of encroachment, the petitioner be granted liberty to approach the Circle Officer, Phulwarisharif Circle, District- Patna for redressal of his subsisting grievances. Liberty so sought is granted.

It is needless to state that in case the petitioner approaches the respondent no. 5, the needful shall be done forthwith.

The writ petition stands disposed off on the aforesaid terms.
