JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-05-2015 Heard learned counsels for the petitioners and the State. The petitioner nos. 1 and 2 being brother in law and sister and petitioner no. 3 being nephew of petitioner no. 1 are apprehending arrest in a case registered for the offences punishable under Sections 328 and 302/34 of the Indian Penal Code.

The accusation is of killing the sister of the informant after three years of marriage by poisoning due to share dispute in the family.

It is submitted by the learned counsel for the petitioners that the accusation is omnibus and general against the entire

Patna High Court Cr.Misc. No.21548 of 2015 (2) dt.20-05-2015 2/2 family. The petitioners are not concerned with the share in the family of the husband of the victim. It is further submitted that the informant has retracted from the initial version and has filed a petition to that effect before the learned court below and the same has been brought on record as Annexure 2.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Motihari, East Champaran in connection with Turkauliya (Banjariya) P.S. Case No. 609 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
