20-08-2016 Heard Sri Viveka Nand Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody in Gogri P.S. Case No. 230 of 2015 registered for the offence under Sections 307, 506 & 34 of the Indian Penal Code and Section 27 of the Arms Act, 1959, has prayed for grant of bail. By way of referring to F.I.R., learned counsel for the petitioner submits that the allegation, which has been levelled against the petitioner, is exactly similar to one of the co-accused, who is none else but own brother of the petitioner namely Sabin Yadav. By way of referring to Annexure - 4 to the petition i.e. order dated 12-01-2016 passed in Cr. Misc. No. 53149 of 2015, learned counsel for the petitioner submits that Sabin Yadav has
Patna High Court Cr.Misc. No.34687 of 2016 (2) dt.20-08-2016 2/2 already been granted bail.
Learned Addl. Public Prosecutor has opposed the prayer for bail, however; he was not in a position to distinguish the case of the petitioner with the case of Sabin Yadav, who has been granted bail.
Keeping in view the fact that co-accused has been granted bail, there is no reason to further detain the petitioner. Accordingly, let the petitioner namely Ravin Yadav @ Rabin Yadav be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Brajesh Kumar, learned Judicial Magistrate, 1st Class, Khagaria in connection with Gogri P.S. Case No. 230 of 2015.
