The petitioner seeks bail in connection with Chakia P.S. Case No. 93 of 2025 instituted for the offence under Sections 126(2), 115(2), 118(1), 109, 303(2), 352, 351(2) & 3(5) of the Bharatiya Nyaya Sanhita, 2023.

On 09.03.2025, the informant was allegedly attacked near his home by seven armed accused, including the petitioner, who assaulted him, attempted strangulation, and robbed his gold chain. The attack was reportedly in retaliation to

It has been submitted on behalf of the petitioner that the petitioner is in custody since 09-05-2025. Petitioner bears no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Learned counsel for the petitioner submits that parties are at loggerheads due to prior dispute. There is no repetition of blow inflicted by the petitioner. Hence, no offence is made out under Section 109 of the BNS, 2023 against the petitioner. Other co-accused has been granted bail by this Court vide order dated 09-07-2025, passed in Cr. Misc. No. 40232 of 2025. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, claim based on parity and nature of accusation, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court
