JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier, the prayer for bail of the petitioner was rejected by this Court but submission on behalf of the petitioner is that petitioner is in jail custody since 02.04.2016 and the alleged occurrence took place in the year 2005 and after investigation, police found the accusation untrue in respect of the petitioner but learned court below differed with the findings of the police and took cognizance of the offence against the petitioner. It is further submitted that the prayer for anticipatory bail of the petitioner was rejected in the year 2008 but due to wrong information of his parvikar he could not surrender before the court below. Patna High Court Cr.Misc. No.34274 of 2016 (2) dt.07-09-2016 2/2 further submitted that moreover, petitioner does not have any criminal antecedent and there is no likelihood of conclusion of trial of the petitioner in near future.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Assistant Sessions Judge-II, Madhepura in connection with Session trial no. 148 of 2013 arising out of Gamhariya P.S.Case No. 18 of 2005.
